1 Purpose and Scope

These General Conditions apply, with the information material available on the website “Parma Travel Food”, the conditions of use and enjoyment of the services provided by Parma Travel Food Ltd. , registered  at C/C n ° REA PR-219580,  P. IVA 02209550348  headquartered in San Secondo Parmense (PR) Via Giovanni De’ Medici, n° 3.

Parma Travel Food, operates mainly on the Internet by providing its clients with a diverse range of services such as tickets and passes online, excursions and tours, restaurants, transfer services ….

In these Conditions references to “Client”  indicate the natural person or corporation who requires the tourist services offered on the web site “Parma Travel Food”, for himself and  all persons on whose behalf a booking is made. References to ” Tourist services ” indicate, including but not limited, the reservation and purchase on-line in any type of accommodation services , including ancillary services or complementary as: transfer from airport to hotel and vice-versa; online purchase of tickets and passes; reservations and purchase online of tickets for concerts, and / or other entertainment and / or events; reservations and purchase online of daily excursions for day or night.

2 Discipline legislation

The purchase of the Tourist Service or the Tourist Package by Parma Travel Food, causes the creation of a direct contractual relationship between the Client and the operator, person or corporation, (organizer – tour operator) that offers the tourist service. In this regard the client before making a reservation, is invited to carefully read the terms of use with a specific indication of the penalties applicable for amendments or cancellations of the booking.

2.1 The agreement between Parma Travel Food, and the Client is adjusted, in addition to the provisions contained in this agreement, also by the provisions of the Legislative Decree may 23, 2011, n.79 (Code of Tourism). In this respect, it invokes the content of the article 34 Of the Code of Tourism, according to which it means for:

  1. tour operator: the person who undertakes, in its own name and in exchange for payment of a lump sum, to provide packages to third parties, by combining the elements of article 34, or offering the tourist, also by means of a system of remote communication, the ability to independently carry out and buy such a combination;
  2. intermediary: the subject who, also not professionally and non-profit, sells or undertakes to procure packages to third parties, made under dell’art.35, for the lump sum of the packages  or single tourist services not aggregated;
  3. tourist: the buyer, the transferee of a tourist package or any person even to be nominated, provided that you also meet all the requirements for the use of the service, on whose behalf the principal contractor agrees to purchase a tourist package without remuneration.Under Article 35 of the Tourism Code, the  package is:  the travel,  the holidays,  the package tours, the cruises, resulting from the combination, by anyone and in any way realized, of at least two of the following components, when sold or offered for sale at an inclusive price : (a) transport; (b) accommodation; (c) other tourist services not ancillary to transport and accommodation and accounting  to the satisfaction of recreational needs of tourists, a significant proportion of the package.

The Client and Parma Travel Food declare and acknowledge that the provisions contained in these general conditions have as their object the sale of tourist services or Packages, made through  Parma Travel Food.  The Client declares and recognizes  that it has independently found the tourist service of its interest on web site www.parmatravelfood.it and requesting as a result the purchase of individual tourist services chosen for independently organize its holiday. The contractor acknowledges that can choose from a variety of tourist services of accommodation and transport on the website www.parmatravelfood.it and that, therefore, the services requested are chosen independently, without adhering to any prearranged combination of tourist services of transport, accommodation and / or tourist services not ancillary to transport and accommodation appropriate to set up a tourist package under current law.

3 Booking  – Terms and arrangements of payment – Amendments / cancellations – Claims

The data relating to the mode of booking, payment, amendments or cancellation with their penalties applicable and the claims are detailed in the conditions of use.

4  Limitations of  liability

4.1 Parma Travel Food, in relation to the booking or purchase of tourist services described in the web site, operates with reference to the obligations assumed under this contract and is responsible only to the obligations that arise from the above-mentioned quality with the limits provided for by the laws in force.

4.2  The Client recognizes and accepts that the access and the functioning of the service of search, request and booking online of tourist services depend on the availability techniques and organizational of Parma Travel Food which not is responsible for any inconvenience, delay or failure of the Service.

The Client acknowledges and agrees that Parma Travel Food, for the provision of the services offered on the web, makes use of electronic communications networks and email systems provided by third parties telecoms operators and is not liable for the interruption or malfunction of the same. The availability of the service can be restricted or interrupted for technical reasons, without notice.

4.3 The use of the services provided by Parma Travel Food on the internet are delivered without any warranty, express or implied, of good operating

Parma Travel Food will not be liable for damage caused by the delay, from faulty operation or from inaccessibility, suspension and/or interruption of services web or electronic communication, as well as the loss and alteration of web pages or data entered by clients.

Parma Travel Food assumes no responsibility for any damage caused by computer viruses, damaged files, errors, omissions, operation of electronic communications networks or e-mail systems, software or hardware incompatibility, unauthorized access, alteration or deletion of data and It will not be held to compensation for damages, losses or costs incurred as a result of such events to the Client, the persons directly or indirectly connected to the Client and / or third parties. Parma Travel Food does not guarantee that the service is provided without interruption, safely and error-free.

Parma Travel Food precise that the judgments, the  opinions and other information that are contained in the web site  may be changed at any  point in time without prior notice.

5 Data protection

5.1 Parma Travel Food in strict accordance with the provisions of Legislative Decree no. 196 of 30 June 2003 on the protection of persons and other subjects regarding the processing of personal data and ensures that under that legislation, the processing of personal data supplied by the client for the execution of the service will be based on principles of fairness, legality and transparency and protection of confidentiality.

5.2 The Client acknowledges that:1) the provider service can identify the client at the time of connection with the identification code assigned it; 2) the access information to the service are contained in the electronic register of the operation (the Log), compiled and kept by Parma Travel Food. The content of the Log is confidential and may be made in an intelligible form and shown only at the request of the competent authorities.

6 Law applicable and the  Court of competent jurisdiction

6.1 This contract is entirely governed by Italian law. For any controversy concerning the interpretation or carrying out of this contract or relating to the use of the Service, is competent  the court of law of residence of the contractor consumer, or if the contractor is not consumer, exclusively the Court of Parma

Terms of use

These Terms of Use govern bookings made via the website “Parma Travel Food” of the following tourist services:

  • tickets and passes for transports, museums and monuments;
  •  excursions and day and evening activities (individual or group);
  • city tour and guided tours;
  • lunches/dinners at restaurant and shows;
  • hire vehicles with and without driver;

Definitions.

In these terms of use the following words shall have the meanings of:

  1. “Parma Travel Food”: means web portal for booking online where you can book services and tourist tickets to Parma (and other destinations).
  2. “Client” : means any person who makes a booking with  “Parma Travel Food” and benefits therefore of the services booked.
  3.  “Order”: means an order / reservation of tickets or services made on ” Parma Travel Food ” that refers to an individual service / ticket , or a cumulative order more tickets and services which resulted in a only payment total.
  4. “Booking”: means booking  a single product or service, inserted in an order and viewable in detail. An order may be therefore composed of more bookings.
  5. “Online catalog” : means the entire catalog of services and tourist tickets offered on the portal “Parma Travel Food”
  6. “Product” : means business or tourist service offered in the online catalog of the website “Parma Travel Food” complete with all its demands and features required for reservation: “Name / Description / cancellation policy / terms of delivery.”

1 RESERVATION

The Client can request an order / booking of products and services tourist with “Parma Travel Food” according to the preferred mode:

  • online on the site “Parma Travel Food”;
  • by telephone, on the Booking Service, calling the number 0521 606059 at the times and days of opening;
  • e-mail, by sending an email request to info@parmatravelfood.it

In any case, when  the Client has making the full payment of the service requested, a binding contract will come into force between the Client  and Parma Travel Food that is subject to these Booking Terms & Conditions.

The reservation is considered completed only when “Parma Travel Food”, received this payment and will be issued a confirmation voucher or ticket associated with the order. To make a booking on the site “Parma Travel Food”, registration is required and the user’s consent to the processing of data.

1.1. Verification of data placed on the reservation

Is need for the Client  carefull control of  the personal data transmitted during the booking, as well as the description and characteristics of the required service. The list of orders placed will be sent to the Client’s  e-mail at the end of his booking and also will be available in the restricted area.

Parma Travel Food cannot be responsible for any inaccurate or incomplete information you give us or for the effect of this on your confirmed booking; this case it may result in the cancellation of the reservation and payment of a penalty for administration costs supported by “Parma Travel Food” for changing or canceling bookings.

The client is required to notify  at the Customer Service of “Parma Travel Food” a cell phone number which “Parma Travel Food” will use  in case of necessity and emergency to provide an rapid and effective service, not for promotional purposes.

“Parma Travel Food” will have the right, at its sole discretion, not to accept the booking request made through the site “Parma Travel Food”

1.2 Personal Documents and request specific assistance

It is responsibility  of the client to check and fulfil the passport, visa, health and immigration requirements applicable to his itinerary. It must also observe the rules of normal prudence and diligence. “Parma Travel Food” shall not be held liable for any adverse consequences incurred by the Client for missing and/or irregularities of identity documents, travel tickets and accommodation or for violation of regulations.

The Client is required to disclose “Parma Travel Food” at the time of booking if a passenger has any medical problem, disability or special needs assistance. “Parma Travel Food” will communicate these requirements to suppliers not assuming any responsibility in case of rejection of the same.

The client confirms that has reached eighteen years of age.

AVAILABILITY

All services and tourist tickets advertised on our site are subject to availability.

3 TERMS AND METHOD OF PAYMENT

The Client agrees to full payment of the reservation according to the selected mode during the booking process:

3.1 online, by credit card or debit card (Visa or Mastercard) through PayPal Virtual POS that is integrated and connected to the platform of e-commerce “Parma Travel Food”, the last step of the purchase.

All payment transactions are carried out on the web site certificate of …… that not store the data on any computer file. “Parma Travel Food” cannot be held liable, in no event, for any fraudulent and unfair use of cards credit by third parties, upon payment for products purchased on the portal.

“Parma Travel Food”, not assume any responsibility for inability to perform the payment process via Virtual POS or to the situation where the owner of the credit card proves devoid of codes for the security system of on-line transactions Secure Code Verified by Visa and Mastercard.

3.2 can be made by bank  transfer

This method of payment will be accepted if the date of the order will be made  eight days before  the service date. “Parma Travel Food” reserves the right to refuse and cancel reservations that  are not paid within eight days of the date of carrying out of service.

The Client must indicate clearly the reason for the payment by entering the reservation code. In the absence of motive “Parma Travel Food” will cannot confirm the reservation. After the payment by bank  transfer, for speed up the registration of payment, please send a copy of the transaction via e-mail info@parmatravelfood.it.  The booking voucher will be sent to the Client by e-mail within five days working of being credited to the bank transfer.

Payment by home banking will be accepted only if they are accompanied by the payment reference number CRO/TRN. We do not accept payment in cash or by check.

4 TRAVEL DOCUMENTS AND DELIVERY OF TIKET/VOUCER

At the end of the order/booking and the following services payment, “Parma Travel Food” shall deliver to the Client the travel documents required for providing the service booked.

To have the right to the service the Client must be in possession  of the travel document, transportation, attraction tickets, confirmation voucher.

Each voucher / ticket must be absolutely  printed and shown to the local supplier.

4.1 Confirmation Voucher sent by e-mail

This is the confirmation document of a dated service, available in digital format, which is sent to the Client by e-mail as attached pdf. The vouchers must be absolutely  printed  and presented to the local supplier for have the right to the service.

This voucher will be sent to the email address that the Client has provided, within 48 hours of payment by credit card or debit card (or within 72 hours in case of payments made during the holidays), or within five working days if the payment is carried out by wire transfer, as indicated in section “Terms and conditions of payment.”

5 AMENDEMENTS/CANCELLATION RESERVATIONS

The customer, prior to booking and purchase, is invited to carefully read the conditions of amendment and cancellation.

5.1 Notification of amendment  or cancellation

Requests for cancellation and amendments must be notified by the Client by e-mail to the email address info@parmatravelfood.it or telephone +39. 0521 606059 during office hours (Monday / Friday from 09.30 to 13.30 and from 15.30 to 19.30) and are considered completed only when Parma Travel Food has received the notification. The cancellation charges vary according to the time that elapsed between notification of cancellation and the date on which they should be provided the services booked.

5.2. Ordinary conditions of cancellation (except special offers and dates)

In general, except in the case of special offer or special dates (in both cases, therefore, subject to restrictive conditions of cancellation) and/or where otherwise specified  in the cancellation policy, the terms and conditions of cancellation are using the tables below:

5.3. Transfer of bookings

The transfer of the booking to a third party is subject to terms and conditions of the supplier and to penalties applied, if necessary, by the same supplier for the change or cancellation.

5.4. Adding Participants

Adding participants to an excursion or transfer, subject to the availability of the service, it will be considered as a change of the booking, and must be accepted by Parma Travel Food that will be sending a possible voucher of confirmation.

5.5 Cancellation or amendment of the service by Parma Travel Food

Hardly Parma Travel Food will make any changes to the trip organization. In the event that Parma Travel Food is not able to supply the service booked, a result of its mistakes, the client is entitled to a refund of the price paid or has the opportunity to accept an alternative service of the same quality, provided by Parma Travel Food, if it’s available.

The Provider reserves the right to cancel a departure and will advise you of such cancellations no later than 60 days before the Tour departure date. If there was a situation because of “Force Majeure” (as detailed below) or government travel advice, the Provider reserves the right to cancel a departure at any time. Either way, with any form of cancellation, the Provider will offer you alternative arrangements, and if the price of your alternative booking is of lower value than the original booking will be refunded the difference in price.  If they are not accepted alternative will be refunded all payments made to the Provider, (in case of ‘Force Majeure’ or government travel advice refunds will be less any unrecoverable costs). The Provider will not be liable for any additional costs incurred by you  and  for any delay in, change to or cancellation of Tours due to “Force Majeure”  (“Force Majeure” shall mean:  a circumstance beyond the reasonable control of the Provider and includes, but is not limited to, war or threat of war, riot, civil strife, terrorist activity, industrial dispute, disease, industrial or nuclear disaster, adverse weather conditions, fire and strikes).

5.6. Ordinary conditions of cancellation (except special offers and dates)

In general, except in the case of special offer or special dates (in both cases, therefore, subject to restrictive conditions of cancellation) and/or where otherwise specified  in the cancellation policy, the terms and conditions of cancellation are using the tables below:

6 REFUNDS

If there are the conditions referred to in paragraph 11, Parma Food Travel will refund the amounts paid for bookings modified or canceled, with the same procedures used for their payment, with certain exceptions. Refunds will be credited in a period between 5 and 10 days of the request.

The payments made by bank credit transfer will be refunded within 7 days of receiving the notification of bank account details, by the client to Parma Travel Food.

7 RESPONSIBILITIES OF CLIENT

Parma Travel Food wants  that its clients had a pleasant travel experience. However, it is important to remember that the client is responsible for his actions and for the effect they can have on others.  Parma Travel Food, can discontinuing the journey or the service of the clients in the event that their actions, during the use of service, may cause difficulties or endanger  to other customers or to its suppliers. Parma Travel Food and its suppliers may charge to the client any costs.
